The Serbian Business Registers Agency (hereinafter: “APR“) has announced that, starting from Friday, October 29, 2024, in the registration procedure initiated by a registration application or ex officio by the registrar, all acts will be delivered to the Unified Electronic Mailbox (eMailbox/eSanduče) of every company that has a registered email address. From that moment, all deadlines will begin to run, and this form of delivery will be equated with personal delivery.
The prerequisite for creating the aSanduče is that the company must first be registered as a user of e-Government services and have a registered email address with the APR, which is a legal obligation for all business entities in accordance with Article 21, paragraph 1 of the Company Law (“Official Gazette of RS,” No. 36/2011, 99/2011, 83/2014 – other law, 5/2015, 44/2018, 95/2018, 91/2019, and 109/2021 “CL“).
On the other hand, in order for a company to be able to retrieve acts delivered to the eSanduče, the applicant for registration (the legal or other representative of the company, or another person authorized by power of attorney) must log in to the e-Government portal using a qualified electronic certificate, whose identification code (personal ID number/passport number/foreign ID card) must match the data already registered with the APR, in accordance with Article 9a of the CL.
Documents can be delivered to the eSanduče either as personal delivery or as a notification, and the user of e-Government services will receive an email notification about the arrival of the electronic document at the company’s email address and the email addresses of the legal/other representatives. The document can then be retrieved at any time.
