The National Assembly of the Republic of Serbia adopted amendments to the Law on Public Property at its session held on November 27, 2024 (“Official Gazette of RS” No. 94/2024, the “Law“). The primary objectives of these amendments are to simplify and streamline the management of public property records, as well as to facilitate access to data and information exchange among relevant authorities.
Key updates introduced by the Law include:
- Changes to Usage Rights:
The Republic of Serbia, autonomous provinces, and local government units no longer have the right to use items in public property or to be beneficiaries of such property.
- Introduction of a Central Registry:
A new information-based Registry for recording immovable public property is being established, aimed at simplifying the inventory and management of property data.
- Transparency and Detailed Records:
Data in the Registry will be publicly accessible unless designated as confidential by law. New criteria for property valuation and improved methods for data exchange among competent authorities have been introduced.
- Obligations for Public Institutions:
Government bodies, public enterprises, institutions, and other legal entities are required to maintain specific records of immovable public property in accordance with the new regulations.
With the entry into force of the Law, the Regulation on the Record of Immovable Property in Public Ownership will cease to apply, as the new Law comprehensively regulates the content and management of the Registry.
